These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Kiraaz ("we," "us," or "Company"), governing your use of the Splitframe application located at https://splitframe.firstwordread.com ("Service").

By accessing or using Splitframe, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Description of Service

Splitframe is a YouTube thumbnail and title A/B testing tool. The Service allows you to:

  • Connect your YouTube channel via Google OAuth.
  • Upload alternative thumbnail images for your videos.
  • Automatically rotate thumbnails on your YouTube videos on a scheduled basis.
  • Track click-through rate (CTR), impressions, and view performance for each variant.
  • Identify winning thumbnails using statistical analysis.

2. Account Registration

To use Splitframe, you must authenticate using your Google account.

  • You must provide accurate information during registration.
  • You are responsible for maintaining the security of your account.
  • You must notify us immediately of any unauthorized access to your account.
  • Accounts created by automated methods (bots, scripts) are not permitted.
  • You may not share account access with others unless explicitly authorized.
  • You may terminate your account at any time through the Settings page or by contacting us.
  • We reserve the right to suspend or terminate an account at our discretion if it violates these Terms. Termination does not entitle you to compensation but does not exempt you from paying any outstanding fees.

3. YouTube API Usage

Splitframe uses the YouTube Data API v3 and YouTube Analytics API to provide its services. By using Splitframe, you also agree to be bound by the Google Terms of Service (https://policies.google.com/terms), Google Privacy Policy (https://policies.google.com/privacy), and YouTube Terms of Service (https://www.youtube.com/t/terms).

3.1 Permissions We Request

When you connect your YouTube channel, we request the following OAuth scopes:

  • youtube.readonly — Read access to your channel info, video list, and metadata.
  • youtube.upload — Ability to set (rotate) thumbnails on your videos during A/B tests.
  • yt-analytics.readonly — Read access to your video analytics (CTR, views, impressions) to measure test performance.

3.2 What We Do With Your YouTube Data

  • We read your video list to display videos available for testing.
  • We upload thumbnail images to your videos as part of A/B testing rotation.
  • We read analytics data (CTR, impressions, views) to determine test results.
  • We do NOT upload, delete, or modify your videos in any way.
  • We do NOT access your YouTube comments, subscribers, or playlists.
  • We do NOT share your YouTube data with any third parties.

3.3 Revoking Access

You may disconnect your YouTube channel and revoke Splitframe's access at any time by going to Settings in the Splitframe dashboard and clicking "Disconnect," or by visiting Google Account Permissions (https://myaccount.google.com/permissions) and removing Splitframe.

Upon revocation, we will stop accessing your YouTube data. Any active A/B tests will be paused, and the last-set thumbnail will remain on your video.

4. Thumbnail Storage

When you upload thumbnail variants for A/B testing:

  • Thumbnail images are stored on our self-hosted infrastructure (MinIO object storage).
  • Images are stored for the duration of the test and retained for 90 days after test completion.
  • You may request deletion of your stored thumbnails at any time by contacting us.
  • You retain full ownership of all images you upload. We claim no rights to your content.

5. Free Plan and Usage Limits

Splitframe currently offers a free plan with the following limits:

  • 3 active A/B tests at a time
  • Up to 5 thumbnail variants per test
  • Daily thumbnail rotation
  • 1 connected YouTube channel
  • Basic analytics

We reserve the right to modify these limits with reasonable notice. Paid plans may be introduced in the future.

6. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable laws or regulations.
  • Upload content that is illegal, offensive, infringing, or harmful.
  • Attempt to reverse-engineer, disrupt, or overload the Service.
  • Use the Service to spam, mislead, or deceive YouTube viewers.
  • Resell, sublicense, or commercially redistribute access to the Service.
  • Scrape, crawl, or harvest data from the Service.
  • Upload thumbnails that violate YouTube's Community Guidelines.

7. Accuracy of Data

The analytics data provided by Splitframe (CTR, views, impressions) is sourced from the YouTube Analytics API and is provided "as is." We do not guarantee the accuracy, completeness, or timeliness of this data. YouTube Analytics data may be delayed by up to 48 hours.

Statistical confidence metrics are based on Bayesian analysis and should be used as a guide, not a guarantee of future performance.

8. Intellectual Property

  • Splitframe and its original content, features, and functionality are owned by Kiraaz.
  • You retain full ownership of all thumbnail images and content you upload.
  • Our trademarks and trade dress may not be used without our prior written consent.

9. Termination

  • You may terminate your account at any time through the Settings page or by contacting us.
  • We may suspend or terminate your account at our discretion if you violate these Terms.
  • Upon termination, your right to use the Service ceases immediately.
  • We will delete your stored data within 30 days of account termination, unless retention is required by law.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

WE ARE NOT RESPONSIBLE FOR ANY CHANGES TO YOUR YOUTUBE VIDEO PERFORMANCE. THUMBNAIL CHANGES MAY OR MAY NOT IMPROVE YOUR CLICK-THROUGH RATE OR VIEWS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIRSTWORDREAD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Kiraaz from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India.
